Drunk driving cases are typically charged under California Vehicle Code 23152(a) and 23152(b) which state:

"(a) It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.
(b) It is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle."

Dr. Widmark, a Swedish physician, developed a formula to determine amount of alcohol consumed, your blood alcohol concentration, or your alcohol elimination rate.  The formula is:

N = f(W, r,Ct ,β , t, z)

where: 
N = amount consumed
W = body weight
r = the volume of distribution (a constant)
Ct = blood alcohol concentration (BAC)
β = the alcohol elimination rate
t = time since the first drink
z = the fluid ounces of alcohol per drink


The second Widmark formula is:


N = Wr(Ct + βt)
0.8z

where: 
N = the number of drinks consumed
W = body weight in ounces
r = volume of distribution (a constant relating the distribution of water in the body in L/Kg)
Ct = the blood alcohol concentration (BAC) in Kg/L
β = the alcohol elimination rate in Kg/L/hr
t = time since the first drink in hours
z = the fluid ounces of alcohol per drink
0.8 = the density of ethanol (0.8 oz. per fluid ounce)
